Terms of Service

You must be at least 18 years of age to use the Platform. By using the Platform, you represent and warrant that you meet this requirement. Local Pass reserves the right to verify eligibility at any time.

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. Notify us immediately at support@imlocal.ca if you suspect unauthorised access.

You may not create accounts for others without their consent or use the Platform in a manner that impersonates any person or entity.

Food delivery: Local Pass facilitates orders between customers and participating restaurants and food businesses ("Merchants"). Local Pass is not a party to the contract of sale between you and the Merchant. Merchants are responsible for the preparation and quality of food items.

Agrifood marketplace: Local Pass provides a marketplace for customers to purchase directly from farms, producers, and food retailers. Availability, pricing, and product descriptions are set by Merchants.

Rideshare: Rideshare services, where available, connect passengers with independent delivery partners ("Drivers"). Local Pass is not a transportation carrier. Drivers are independent contractors, not employees of Local Pass.

Prices displayed on the Platform are set by Merchants and may be subject to service fees, delivery fees, and applicable taxes. All fees are disclosed before you confirm your order.

Payment is processed at the time of order confirmation. Refunds are subject to our Refund Policy, available on the Platform.

Local Pass uses Stripe for payment processing. By making a purchase, you agree to Stripe's terms of service.

Local Coins are a loyalty currency issued by Local Pass. They have no cash value, are non-transferable, and may not be redeemed for cash. Local Pass reserves the right to modify, limit, or discontinue the Local Coins programme at any time with reasonable notice. Accumulated Local Coins may be forfeited if your account is terminated for breach of these Terms.

Merchants and Drivers agree to separate onboarding agreements that supplement these Terms. In the event of conflict between those agreements and these Terms, the onboarding agreement governs with respect to the specific relationship.

You agree not to:

• Use the Platform for any unlawful purpose or in violation of applicable law
• Place fraudulent orders or provide false information
• Harass, threaten, or abuse Merchants, Drivers, or other users
• Attempt to reverse-engineer, scrape, or disrupt the Platform
• Create multiple accounts to exploit promotions or circumvent restrictions
• Use the Platform to transmit spam, malware, or harmful content

Violation of these prohibitions may result in suspension or termination of your account.

All content, trademarks, logos, and software on the Platform are owned by or licensed to Local Pass. You may not reproduce, distribute, or create derivative works from any Platform content without our prior written consent.

The Platform is provided "as is" without warranties of any kind, express or implied. Local Pass does not warrant that the Platform will be uninterrupted, error-free, or free of harmful components. To the maximum extent permitted by applicable law, Local Pass disclaims all implied warranties, including merchantability and fitness for a particular purpose.

To the maximum extent permitted by applicable law, Local Pass shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Platform, including loss of data, revenue, or goodwill, even if Local Pass has been advised of the possibility of such damages.

Local Pass's total liability to you for any claim arising from your use of the Platform shall not exceed the amounts paid by you to Local Pass in the three months preceding the claim.

These Terms are governed by and construed in accordance with the laws of British Columbia and the federal laws of Canada applicable therein. Any disputes shall be resolved in the courts of British Columbia, and you consent to the exclusive jurisdiction of those courts.

We may update these Terms from time to time. Material changes will be communicated by posting the updated Terms with a revised date and, where appropriate, by email. Continued use of the Platform after updated Terms are posted constitutes your acceptance of those changes.
